Policies for Inclusive Safe Space (Confidentiality, Anti-Bullying, etc.) 

Participation in Philo4Thought discussions and activities at any level requires all parties agree to the following Safe Space Terms & Conditions. Registration for any of our services, membership options, private chatrooms, etc. is considered a permanent and binding acknowledgement and confirmation of this agreement

1. TERMS & CONDITIONS

  • Philo4Thought Inc. (“Philo4Thought”) provides training and services relating to academic and professional development and to related personal development coaching when (i) visiting or accessing “https://www.philo4thought.org”, (ii) participating in seminars, workshops, symposiums, presentations, networking events, chatrooms, tutorials, programs and any other events or activities hosted or affiliated with Philo4Thought, (iii) receiving materials, information and other resources provided or referenced by Philo4Thought, or (iv) otherwise receiving general or individualized career advisement, insights and guidance from Philo4Thought via any other written or oral communication (collectively, the “Philo4Thought Services”). Philo4Thought provides the Philo4Thought Services, subject to the Terms and Conditions defined below.
  • By participating in or using Philo4Thought Services, irrespective of the location where (i) the applicable Philo4Thought Services are rendered by a Philo4Thought Service Provider and (ii) the applicable Philo4Thought User participates in or utilizes such Philo4Thought Services, you agree to the following terms and conditions (“Terms and Conditions”). Please read them carefully.

2. STANDARDS OF CONDUCT

  • In connection with any Philo4Thought Services, each third party that is invited to give a presentation or participate in a panel discussion or otherwise provide information or guidance as a mentor (collectively, a “Philo4Thought Service Provider”) and each Philo4Thought User shall use good faith efforts to comport to reasonable conduct and, where applicable, uphold reasonable professional standards, in accordance with the relevant circumstances. In no event shall any Philo4Thought Service Provider nor any Philo4Thought User harass, engage in unprofessional or unwanted communications or otherwise engage in any actions that would result in materially adverse consequences to Philo4Thought, any Philo4Thought Service Provider, any Philo4Thought User or any individual to whom a Philo4Thought User was referred for mentoring or other purpose relating to networking and professional development (“Philo4Thought Referral Recipient”).  For the avoidance of doubt, any communication between a Philo4Thought User and a Philo4Thought Referral Recipient should be utilized by the Philo4Thought User solely for professional and networking purposes and should not be misused for any other social purposes.
  • In the event that any Philo4Thought Service Provider or Philo4Thought User observes or becomes aware of any material failure by another Philo4Thought Service Provider or another Philo4Thought User, as applicable, to comply with the foregoing standards of conduct, then such Philo4Thought Service Provider or Philo4Thought User, as applicable, will use good faith efforts to inform the Board of Directors in reasonable detail about the applicable individuals involved and any relevant information about such failure to comply.

3. MENTORING PRIVACY & CONFIDENTIALITY AGREEMENT

  • In connection with any Philo4Thought Services, it is likely that (a) Philo4Thought, (b) any representative, volunteer, or agent acting on behalf of Philo4Thought or (c) any Philo4Thought Service Provider will be the recipient of, or otherwise become aware of, non-public confidential information of any participant or user of such Philo4Thought Service (“Philo4Thought User”). Such confidential information may include, without limitation, information relating to such Philo4Thought User’s academic and professional career. Philo4Thought agrees to keep in strict confidence all non-public confidential information of any Philo4Thought User so long as it remains non-public, except to the extent that any disclosure of such information is (a) expressly permitted under these Terms and Conditions, (b) required by law, (c) requested by any governmental or regulatory agency or body or (d) expressly or implicitly permitted by such Philo4Thought User.
  • Information may be shared internally between members of the Board of Directors of Philo4Thought, any Philo4Thought Service Providers, or any representatives or agents of Philo4Thought specifically for the purpose of identifying and improving available programming, publications and resources and other reasonable purposes in connection with any current or anticipated Philo4Thought Services. 
  • All Philo4Thought Service Providers and Philo4Thought Users are fully expected to respect and uphold the standards for Safe Space established by the State of New York in connection with any Philo4Thought Service, including without limitation any Philo4Thought Service that is held on an online platform or medium or any event or activity held outside the State of New York.
  • Non-public confidential information relating to any Philo4Thought User may be disclosed by Philo4Thought so long as it is reasonably related to any Philo4Thought Services (including any sharing of internship applications to recruit a suitable Philo4Thought Service Provider to act as a mentor for such intern and any submission of biographies of scholarship recipients or honorees to a New York State governmental authority for the issuance of certificates or accolades).
  • The non-public confidential information of any Philo4Thought User (including any intern of Philo4Thought) is protected by the FERPA/Buckley Amendment of 1974 (see https://www2.ed.gov/policy/gen/guid/fpco/ferpa/leg-history.html) unless the applicable individual completes a standard waiver form from their respective university or school.
  • Each Philo4Thought User who is under the age of 18 years old will be required to fill out a standard form (which should be available at their academic institution, but also on Philo4Thought’s website to be completed at their academic institution) prior to the use of any Philo4Thought Services.

4. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

  • ALL PHILO4THOUGHT SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO PHILO4THOUGHT USERS THROUGH PHILO4THOUGHT SERVICES OR OTHERWISE ARE PROVIDED BY PHILO4THOUGHT ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. PHILO4THOUGHT MAKES NO REPRESENTATIONS OF WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE PHILO4THOUGHT SERVICES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH PHILO4THOUGHT SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. EACH PHILO4THOUGHT USER EXPRESSLY AGREES THAT HIS OR HER USE OF ANY PHILO4THOUGHT SERVICES IS AT HIS OR HER OWN RISK.
  • TO THE FULLEST EXTENT PERMISSIBLE BY LAW, PHILO4THOUGHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PHILO4THOUGHT DOES NOT WARRANT THAT THE PHILO4THOUGHT SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE THROUGH THE PHILO4THOUGHT SERVICES OR PHILO4THOUGHT’S ELECTRONIC COMMUNICATIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER PHILO4THOUGHT NOR ANY PHILO4THOUGHT SERVICE PROVIDER WILL BE LIABLE FOR ANY INJURIES OR DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY PHILO4THOUGHT SERVICES, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO ANY PHILO4THOUGHT SERVICE PROVIDER OR PHILO4THOUGHT USER THROUGH ANY PHILO4THOUGHT SERVICE, INCLUDING BUT NOT LIMITED TO (A) DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING AND (B) ANY DAMAGES ARISING FROM ANY TRANSMISSION OR CONTRACTION OF COVID-19 THROUGH ANY INTERACTION AMONG PHILO4THOUGHT SERVICE PROVIDERS, PHILO4THOUGHT USERS OR ANY OTHER PERSONS IN CONNECTION WITH ANY PHILO4THOUGHT SERVICE OR OTHERWISE.

5. OTHER DISCLAIMERS

  • The views, information, or opinions expressed by any Philo4Thought Service Provider or any Philo4Thought Service User in connection with any Philo4Thought Service are solely those of such individual and do not necessarily (a) represent those of Philo4Thought or any other Philo4Thought Service Provider or any other Philo4Thought User or (b) reflect the views of any employer of, or any company affiliated with, such individual.

6. POLICIES FOR SAFE SPACE & INCLUSIVE CODE OF CONDUCT

  • In New York State, a “Safe Space” is a physical/metaphysical place where individuals from minority classifications convene away from offensive or harmful ideas among members. Safe Spaces are locations (online or face to face) where all parties agree to speak openly and without judgment, prejudice, ridicule, criticism, hostile opposition, retaliation, etc. This policy protects all participating individuals (i.e., any marginalized/minority classification) from active/passive bullying by instructors, classmates, peers, etc. (Judith ShulevitzHeidi Kitrosser).
  • Philo4Thought upholds a strict Safe Space Policy during all Philo4Thought Services. Those participating in group meetings, online correspondence, etc. are not to engage in any hostile conduct. Individuals who do not uphold this code of conduct by engaging in actively or passively hostile or hurtful behavior towards any member of the Board of Directors of Philo4Thought, any Philo4Thought Service Provider, any Philo4Thought User, etc. will be banned from further contact with any member of our group, all mailing lists, etc.
  • Philo4Thought programming was specifically established to support the professional development interests and needs of young professionals. While Philo4Thought does not discriminate against individuals based on gender identity, age, etc. (in accordance with Title VII regulations), the specific team members of Philo4Thought are not directly equipped to address the needs of those who fall outside the range of their collective areas of expertise. Philo4Thought will, however, offer a reliable referral to available affiliates to address the needs of those who fall outside the reasonable scope of the Philo4Thought team’s collective areas of expertise.
  • Harassment at any level will not be tolerated (Enforcement of Safe Space, Anti-Bullying and Title IX regulations of the U.S. Department of Education apply).
  • Any Philo4Thought Service Provider, Philo4Thought Service User or any other individual affiliated with Philo4Thought who fails to respect these Terms and Conditions by engaging in unseemly behavior will receive one probationary warning. If such unseemly behavior persists, such person will be asked to leave or discontinue any Philo4Thought Service.

7. PHOTO/VIDEO RELEASE FOR ANNUAL SYMPOSIUM & NETWORKING SOCIALS

  • Philo4Thought-approved photographers, videographers and press are granted permission to take photographs and video recordings in connection with any Philo4Thought Services that capture general activities that do not pertain to individualized Philo4Thought Services. Such content will be used solely for training and review purposes, Philo4Thought’s promotional materials and social media and other purpose reasonably related to Philo4Thought Service. However, no person will be permitted to take any photographs or video recordings of any individualized Philo4Thougth Services that involve non-public confidential information relating to any Philo4Thought User.
  • No Philo4Thought Service Provider or Philo4Thought User may use any photo, video or intellectual property owned by Philo4Thought (including any logos) without the express written consent of Philo4Thought.

8. NATURE & DEFINITION OF HISTORICALLY IDENTIFIED MINORITY GROUP

  • A “Minority Group” (i.e., “Marginalized/Underrepresented Group”) is broadly defined as a group of individuals whose physical, cultural or behavioral characteristics have led to different and unequal treatment leading to collective discrimination, harassment and/or retaliation (Louis Wirth). Objectively, the term refers to a publicly identified social classification based on ethnicity, race, gender, religion, etc. Subjectively, the term refers to an identity ascribed to by the members of the group in question for the purposes of establishing professional and social identity and solidarity. 
  • “Hellenes” and “Greek-Americans” are historically classified as a religious and ethnic minority group, having suffered discriminatory practices, including (1) the restriction or denial of employment based on ethnic bias, (2) religious persecution, (3) public bias based on past and present socio-economic perspectives, hyperbolic media publications, etc. that portray this group as being socio-economically backwards and inferior to the majority group.
  • The “Hellenic” and “Greek-American Community” consists of a predominant combination of (1) long-established ethnic populations throughout the U.S., (2) recent immigrant families, (3) first-generation Americans of Greek decent and (4) the religious minority group identified as “Greek Orthodox”.
  • Philo4Thought has adopted a policy of Affirmative Action (as defined below) in connection with its management and any Philo4Thought Service. “Affirmative Action” is broadly defined as policies established to prevent discrimination, harassment and retaliation of an underrepresented group (or individual) based on race, ethnicity, religion, gender, national origin, etc., countering the effects of historical discriminatory practices. 
  • Philo4Thought is committed to promoting and implementing “Affirmative Action Initiatives”, which provide a variety of supportive services to Minority Groups and any marginalized groups. For example: “…Minority groups who primarily speak a marginalized language [required] extra teaching in the majority language, so that they are better able to compete for places at university or for jobs” (Lumen Learning).
  • Philo4Thought provides community support to students and professionals of the Hellenic and Greek American Community. Philo4Thought acknowledges the legacy and contributions of various organizations that have been established since the 1920s to help fight against religious persecution and discriminatory practices in the workplace, particularly in the Hellenic and Greek American Community. Most notably, in 1965, Archbishop Iakovos, the religious leader of the Greek Orthodox community in North America and South America, marched alongside Rev. Dr. Martin Luther King Jr. in the now-famous peaceful protest in Selma, Alabama in solidarity against the overt discriminatory practices of the established majority against racial, ethnic and religious groups, mainly against the African American community and also against other groups, including Greek Americans.
